Terms of Service

Whimgram ("Platform", "we", "us", "our") is a social platform that allows users to join chat rooms, post messages, and interact with a community of creators and contributors.

These Terms of Service ("Terms") govern your access to and use of the Whimgram website, application, and all related services. By using the Platform, you enter into a binding agreement with Whimgram.

You must be at least 18 years of age (or the age of majority in your country, whichever is higher) to create an account. By registering, you confirm that:

• You are at least 18 years old
• You have full legal capacity to enter into these Terms
• You are not prohibited from using the Platform under applicable law
• All registration information you provide is accurate, current, and complete

To access platform features, you must register with a valid email address, username, display name, and password. You are solely responsible for:

• Maintaining the confidentiality of your password
• All activity that occurs under your account
• Immediately notifying us at [email protected] if you suspect unauthorised access

We use IP addresses and device fingerprinting during sign-up to prevent abuse. Accounts created through proxies, VPNs, or automated tools may be flagged or removed without notice.

When using Whimgram, you agree not to:

• Post content that is abusive, harassing, threatening, hateful, discriminatory, or defamatory
• Post sexually explicit, obscene, or pornographic content
• Share content that violates any third party's intellectual property rights
• Post spam, chain messages, or repetitive low-quality content
• Submit AI-generated content as your own original work — our platform uses automated systems to detect AI-generated text and such messages are subject to penalty and account action
• Post duplicate or near-duplicate messages across rooms or within a short time window
• Use bots, scripts, macros, or automated tools to post messages or interact with the Platform
• Impersonate any person, organisation, or Whimgram staff member
• Attempt to gain unauthorised access to other users' accounts or platform systems
• Upload malicious code, viruses, or harmful files
• Engage in any activity that disrupts, degrades, or impairs the Platform

You retain ownership of the content you post on Whimgram. By posting content, you grant Whimgram a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display, reproduce, and distribute your content on the Platform and in connection with Whimgram's services.

Whimgram and its original content, features, branding, and technology are and remain the exclusive property of Whimgram and its licensors. You may not copy, modify, distribute, sell, or lease any part of the Platform or its software.

Some chat rooms may require a paid subscription to join or access content. By subscribing to a room, you agree to the subscription price displayed at the time of purchase. Room subscriptions are processed directly via a secure payment gateway. Subscription fees are non-refundable except as stated in our Refund Policy.

Of each subscription fee, 70% is credited to the room creator and 30% is retained by Whimgram as a platform fee. Subscription prices are set by room creators, subject to Whimgram's platform-wide minimum and maximum limits. Subscribing to a room does not affect your standing in the Creator Program — subscribed members earn from weekly reward pools on the same basis as all other members.

Whimgram awards Experience Points (XP), user levels, and achievement badges based on your activity and contributions. These are platform recognition features with no guaranteed monetary value. We reserve the right to adjust, reset, or remove XP, levels, and badges at any time without notice or liability.

Whimgram offers an optional rewards program for active contributors. Participation in this program is subject to the separate Creator Program Terms, which are incorporated herein by reference. Eligibility, rewards, and program rules may change at any time.

We reserve the right — but not the obligation — to monitor, review, remove, or restrict any content or account at our sole discretion. Actions we may take in response to violations include:

• Issuing a warning
• Removing offending content
• Temporarily suspending your account
• Permanently banning your account
• Forfeiting accumulated points or pending payouts
• Reporting violations to relevant authorities where legally required

Automated content moderation systems run continuously. Messages flagged as spam, AI-generated, or duplicate are automatically penalised and may be removed.

If you opt in to push notifications, we will send you relevant alerts about activity on the Platform. You can withdraw consent at any time through your browser or device settings. We use the Web Push standard to deliver notifications and do not share push subscription data with third parties.

You may upload images and other media files up to 25 MB per file. By uploading media, you confirm you own the rights or have permission to share it and you grant Whimgram the licence described in Section 5. We are not responsible for content uploaded by users. Media that violates these Terms will be removed.

Whimgram is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or uninterrupted service. We do not guarantee that the Platform will be error-free, secure, or available at all times.

To the fullest extent permitted by applicable law, Whimgram and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of data or goodwill — even if we have been advised of the possibility of such damages.

You may delete your account at any time. We may suspend or terminate your account at any time, with or without notice, if we determine you have violated these Terms or for any other reason at our discretion. Upon termination, your licence to use the Platform ends immediately. If termination is due to a violation, your accumulated points and any pending payouts may be forfeited.

We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. Continued use of Whimgram after changes constitutes your acceptance of the revised Terms. If a change is material, we will provide reasonable notice through the Platform.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
